Description |
|
The
legal issues which impact the disciplining of students are dynamic and
complicated for Georgia administrators.
Those who are responsible for making decisions regarding the
due process procedures to which students are entitled and the
consequences of rule
infractions require the
most comprehensive and up-to-date legal information available.
The State Board of Education and the courts will closely
scrutinize such decisions for violations of the student’s rights.
These rights are set forth in federal and state laws which
define the parameters within which administrators, tribunals, and
boards of education may discipline students.
Also, students who are disabled have additional protections
under the law. Students
who are disabled under Section 504 of the Rehabilitation Act of 1973
may not be punished for behavior that is a result of their
disabilities. Also,
students who receive special education and related services under the
Individuals with Disabilities Education Act (IDEA) may not have those
services interrupted except under certain procedural guidelines.
Educators must be knowledgeable of all of the mandates
regarding student discipline. The Student Discipline Handbook is designed as a legal reference.
